Terms of Use

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”) and Fifth Sierra, a Tennessee-based business entity. By accessing, browsing, enrolling in, or using any of the services offered by Fifth Sierra—including but not limited to online education, Lean Six Sigma belt certification, coaching, and consulting—you agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use our services.

Certifications offered by Fifth Sierra are contingent upon successful completion of coursework and the passing of corresponding assessments. It is the sole responsibility of the User to meet these standards to be eligible for certification.

Each User account is personal, non-transferable, and intended for individual use only. Users are strictly prohibited from sharing their login credentials or providing access to their account to any other party. Violation of this condition will result in immediate termination of the account and forfeiture of any associated rights or services.

All content offered through Fifth Sierra—including but not limited to text, videos, course materials, branding, coaching guides, and certification tests—remains the intellectual property of Fifth Sierra and is protected under United States and international copyright laws. Any reproduction, redistribution, or unauthorized use is strictly prohibited.

Fifth Sierra’s educational and consulting services are generally open to individuals of all ages. However, special conditions apply for minors:

  • Any individual under the age of 13 must have a parent or legal guardian contact Fifth Sierra directly at [email protected] prior to registration for certification programs.
  • Individuals under the age of 18 who wish to engage in one-on-one consulting or coaching services must be accompanied by a parent or guardian for the duration of all sessions.

Fifth Sierra welcomes users from all countries. However, all Users, regardless of their physical location, agree that their use of this website and associated services shall be governed by the laws of the United States and the State of Tennessee. Any disputes arising from these Terms or the use of services shall be exclusively resolved in a court of competent jurisdiction located in the State of Tennessee, and you hereby consent to such jurisdiction and venue.

Refunds are not guaranteed and will only be considered under extenuating circumstances at the sole discretion of the owner of Fifth Sierra. All decisions regarding refunds are final and not subject to appeal.

These Terms may be updated at any time without prior notice. Continued use of the site and services following the posting of changes constitutes your acceptance of the revised Terms. Users are encouraged to review these Terms periodically.
